Terms of Service

These Terms of Service govern the Bluux website, web application, child profiles, cloud project storage, and related services made available by Bluux LLC ("Bluux," "we," "our," or "us"). By using Bluux, you agree to these Terms.

Bluux is a separate product of Bluux LLC. It was built in part from BSD-3-Clause-licensed ScratchJr source code, but it is not the original ScratchJr project and is not affiliated with, sponsored by, or endorsed by MIT, the MIT Media Lab, Tufts University, Playful Invention Company, or the original ScratchJr contributors.

Bluux accounts are intended to be created only by adults, including parents, guardians, teachers, schools, or other authorized adult supervisors. Children should not create their own Bluux accounts.

If you create an account for a household, classroom, or child, you represent that you are authorized to do so, that the registration information you provide is accurate, and that you will supervise child use of the service.

Bluux is designed so that child profiles can use nicknames or first names and preset avatars. Do not place a child's full name, email address, phone number, home address, or other unnecessary personal information into a child profile, project title, or project content.

If you are the adult account holder, you are responsible for reviewing, managing, and, where appropriate, deleting child profiles and projects associated with your account. Our Privacy Policy describes the parental rights and choices we make available.

You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs through your account. Notify us promptly at bluuxllc@outlook.com if you believe your account has been accessed without authorization.

We may require email verification, password resets, or other account-security steps to protect accounts and child data.

You retain responsibility for the projects, artwork, audio, text, and other content created or uploaded through Bluux. You grant Bluux LLC a limited, non-exclusive right to host, store, transmit, back up, synchronize, and display that content only as needed to operate, secure, and improve the service for you.

You represent that you have the right to use any content you upload to Bluux and that your use of the service will not violate another person's rights.

You may not use Bluux to break the law, infringe intellectual-property rights, interfere with the service, attempt unauthorized access, upload malicious code, abuse children or other users, or submit unlawful, harmful, or deceptive content.

We may suspend or limit access if we reasonably believe an account or project is being used in a way that harms the service, children, other users, or Bluux LLC.

Bluux is an evolving software service. We may add, change, pause, or remove features, storage limits, integrations, or availability at any time. We will try to avoid unnecessary disruption, but we do not guarantee that every feature will always be available or error-free.

Our Privacy Policy explains how Bluux handles adult account information, child profile data, project storage, email verification and reset flows, and parental requests. By using Bluux, you acknowledge that the Privacy Policy is part of these Terms.

To the maximum extent permitted by law, Bluux is provided on an "as is" and "as available" basis. We do not make guarantees that the service will be uninterrupted, perfectly secure, or error-free.

To the maximum extent permitted by law, Bluux LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from your use of the service. Nothing in these Terms limits liability that cannot lawfully be limited.

We may update these Terms from time to time. If we make material changes, we will post the updated version here and update the "Last updated" date.
